GLOBALSTAR INFORMATION FOR SUBSCRIBERS

1. Your Supplier. You are purchasing Globalstar Service from an independent reseller. Your supplier's ability to offer you Globalstar Service is derived from and limited to the terms of a reseller agreement between your supplier and Globalstar USA, Inc. Your Globalstar Service will be terminated if your supplier's reseller agreement terminates.

2. Ability to Continue Service. If your Globalstar Service is terminated due to the inability of your supplier to continue offering Globalstar Service, you may be able to purchase Globalstar Service directly from Globalstar USA, Inc. or from an authorized distributor of Service promptly following such termination.

3. Access Numbers. Except where the law provides otherwise, Globalstar USA, Inc. owns the Access Number assigned to your Globalstar User Terminal. To the extent permitted by law, Globalstar USA, Inc. reserves the right to change your Access Number. Additionally, your privileges to use the Access Number may be withdrawn upon the termination of Globalstar Service.

4. Limitation of Liability. Subscriber acknowledges and agrees that liability of the supplier of Service and of Globalstar USA, Inc. for damages due to any failure, disruption or degradation in Service shall be limited to the charges imposed for the affected Service for the period such failure, disruption or degradation occurred. This limitation of liability also applies to emergency calls (911). IN NO EVENT SHALL EITHER SUPPLIER OR GLOBALSTAR USA, INC. BE LIABLE, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, FOR LOSS OF PROFITS, OR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

5. Fraud and Abuse. Subscriber acknowledges receipt of AirTouch's Anti-Fraud and Abuse Policy and Subscriber covenants to Reseller that Subscriber will not engage in conduct prohibited by such policy.
