1. General Statement of Policy. Globalstar Service is available only to Subscribers who
(a) access Globalstar Service using Company-authorized equipment in the manner such equipment is designed to be used,
(b) are not using Globalstar Service in furtherance of criminal or harassing activity and
(c) pay all charges incurred. Any other connection to or use of Company's System or the Globalstar System will be considered to be fraud or abuse. Company is under no obligation to supply Globalstar Service to any person suspected of engaging in fraud or abuse.
2. Fraud. Examples of subscriber fraud include:
(a) Accessing or attempting to access Globalstar Service by using an unauthorized device or by tampering with or altering authorized user terminal equipment;
(b) Obtaining or attempting to obtain permission to access Globalstar Service by providing false or misleading information;
(c) Obtaining Globalstar Service without having the intent to pay charges incurred;
(d) Intentionally interfering with or causing disruptions in Company's provision of Globalstar Service to other subscribers; and
(e) Selling or otherwise transferring a Globalstar access number or account to another person.
3. Abuse. Examples of subscriber abuse include:
(a) Using Globalstar Service to further criminal activity;
(b) Using Globalstar Service to make unwanted foul or profane expressions, to impersonate another person with fraudulent or malicious intent, or to call another person so frequently or at such times of day or in any other manner with the intended effect of annoying, threatening or harassing such other person; and
(c) Using Globalstar Service in a manner that interferes unreasonably with the use of Globalstar Service by one or more other subscribers.
4. Distributor's Responsibilities. Each reseller, agent or other distributor of Globalstar Service is required to assist Company in enforcing this policy by taking the following steps:
(a) Advising all subscribers of the terms of this policy;
(b) Promptly notifying Company of any incident of fraud or abuse of which the distributor becomes aware;
(c) Assisting Company upon request in the investigation of any suspected fraud or abuse; and
(d) Discontinuing the provision of Globalstar Service to any person whom Company designates as suspected of fraud or abuse or whom distributor reasonably suspects of fraud or abuse.
Fraud or abuse by a subscriber enlisted by a reseller will not relieve the reseller of its obligation to pay Company for charges incurred.
